C-Way Fair Use Policy

Most FNO’s (Fibre Network Operators) provide FTTH services based on the FNO’s Uncapped product offering. The fibre line provided by the FNO can vary due to certain limitations attributed to their FTTH network. This applies to both fibre and wireless to fibre services.

In general, FTTH means “Fibre to the Home”. FTTH services are not be used to generate business. Business activities will be classified as FTTB. The Broadband access service is provided over a shared, “best effort” and contended network with limited service guarantees, which may be impacted by the activities of other users. Therefore, FTTH services may not be used as a distribution “break out” to resell internet services to other users. This will be classified as FTTB. The purpose of FTTH is to supply internet services to the end user “at home”.

To help ensure that all customers have fair and equal use of the service and to protect the integrity of the network, C-Way reserves the right to monitor the network for excessive use. “Excessive usage” means usage in excess of 5000GB per month.

In the event that a user does exceed the set excessive usage, the internet line speed will be throttled to 25% of the overall line speed for the remainder of the calendar month. The connection will remain uncapped and unshaped for this period. The line speed will revert to its base profile at the beginning of a new month.  

The action that C-Way may take includes, but is not limited to:

  • Shaping throughput
  • Prioritising services utilising specific ports or communication protocols;
  • Rate limiting throughput
  • Excessive usage fees as per the FNO’s FUP may apply and will be for the end user’s account. This is expressed as a percentile of over usage and are charged according to the FNO over usage rate. 

This policy applies to and will be enforced for both intended as well as unintended (e.g., viruses, worms, malicious code, or otherwise unknown causes) excessive usage.  Where excessive usage is as a result of unintended usage, C-Way may request that the source of the unintended usage be removed.

When you choose this option, we will assist you with a free installation. All we require is that you return the initial installation fee to us when you cancel or when your payment falls into arrears. The equipment remains our responsibility to replace and maintain because it remains our property. So you never need to worry that the equipment needs to be insured or damaged.
